De acuerdo con el artículo 26.1 d) de la Ley 7/1985, de 2 de abril, reguladora de las Bases de Régimen Local, los municipios con población superior a 50.000 habitantes tienen la obligación legal de prestar los servicios públicos de transporte colectivo urbano de viajeros. La titularidad del servicio corresponde al Excmo. Ayuntamiento de Jaén. El servicio ostentará en todo momento, la calificación de servicio público municipal.
